I will add some of my perspective to this shortly. 
I don't think the Law has done an acceptable job of keeping up with Technology or Privacy,
in many cases the Law makers have used these holes for nefarious purposes.

Start it off with what is the application of the 4th Amendmant in todays digital data
mined world.

Don't worry this is not strictly an American thing, our 4th Amendment is based upon
British law, so there is something roughly similar in most countries
